大多數國際社會缺乏對台灣法律上的承認將不利於台灣人民的國際人權自決權。在與台灣的雙邊關係中,國際社會一致認同要按照國際法把台灣當作主權國家的要求,在現實上,通過法律來承認台灣的國家主權。雖然目前這種情況並不直接侵犯台灣的自決權,但這種法律上承認的歧義將使台灣被中國吞併的風險增高。根據國家構成理論的觀點,台灣將失去國家的地位,並且當大多數國際社會將台灣視為中國的地方政府時,台灣的自決權將會受到侵犯。在“一個中國”政策延伸到雙邊的背景之下來否認台灣在聯合國的代表權之時,這違反了普世主義原則,即通過阻止國家在世界機構中實現其代表權的行為來侵犯台灣自決權。 除了確保台灣在國際上有發聲的舞台來保護自己免於受到中國擴張主義,排除台灣的聯合國會員資格,也會降低通過聯合國和平機制減少兩岸關係發生的戰爭的可能性。
Abstract
The broad lack of de jure recognition accorded to the state of Taiwan by most of the international community is detrimental to the international human right of self-determination of the people of Taiwan. In its bilateral relations with Taiwan, the international community at large complies with international law’s requirement of treating Taiwan as a sovereign state, in a de facto sense, by legally recognizing the sovereignty of Taiwanese statehood. Although this does not directly offend Taiwanese self-determination in the present, the ambiguity puts Taiwan at greater risk of annexation from China than if de jure recognition were granted. Taiwan would lose its statehood, according to a constitutive perspective, and its self-determination would be violated should the international community at large reverse itself by treating Taiwan as sub-sovereign to China. When the ‘one China’ policy is extended beyond the bilateral context to deny Taiwan representation in the United Nations (UN), this is a violation of the principle of universalism that offends Taiwanese self-determination by blocking the nation’s right to realize its representation in the world body. Besides ensuring that Taiwan has an unequal voice in international arena to defend itself against Chinese annexation, exclusion from the UN membership effectively cuts Taiwan off from access to UN peace mechanisms that could help reduce the likelihood of war in cross-strait relations.
