摘 要

有鑑於台灣的水資源看似豐富，但受季節性之影響，降雨型態在時間與空間分佈極不平均。加上地形特殊，河短坡陡以及山坡地的不當開墾與新水庫開發、成本過高等供給面管理的困難，水資源的開發利用與蓄存不易，因而產生缺水的問題。需求面的管理，卻礙於水利法的諸多限制及地方利益團體的操控，阻礙了水資源的使用與配置效率。

本研究即在檢討台灣目前的水權制度，研礙法令制度革新方案，嘗試提出適用於現階段的改革制度。同時透過經濟學原理，探討如何經由制度的設計，透過政府對水利會可能產生獨占價格剝削的問題予以管制。設計出一套以買賣雙方「自利動機」為導向的制度，將水資源導入自願性交易市場，使水利會可以從交易中取得應有報酬，產生改善渠道設施與漏水問題之節水與釋水誘因；取水部門亦能落實「使用者付費」原則。將可有效解決乾旱時期台灣水資源調配失衡與新市政及工業區開發之缺水的問題，達到節約用水與有效配置的目的。

並著重於實務面的探討，透過水利署、農委會等主管機關之訪談，在現行水權制度的規範下，研擬如何同時透過市場機制與政府獨占價格的管制，以做為未來我國如何建立一套更合理的水權制度之參考。將各部門移轉的水發揮最大經濟效益，進而對台灣經濟的永續發展產生助益。
